Yes...when jury is asking about definition of manslaughter and if they can consider the castle law it strongly pointed to not guilty. Very surprised it went the way it did after that. I thought with jury makeup she was toast, as it pointed that way based on racial makeup. A rollercoaster for sure. EDIT: Just heard it reported the Jean family was very concerned about the verdict when jury asked about manslaughter and castle law. Again, very reasonable to conclude it wasn't looking good for a guilty of murder verdict at that point.

Yes, Ack... definitely jumped to conclusions. Reasonable conclusions based on available evidence. I said initially I thought she should be found guility and get 8 years. Now, at 1pm CDT sentencing starts and she has to get between 5-99 years. BTW, this was my exact quote above after the info on jury questions: She's getting off or getting manslaughter at best...

I'm extremely disappointed in hearing from Botham's attorneys. Made it ALL ABOUT RACE. It was very sad. Listed off 15 African Americans who were shot by police. The guy was freaking fired up going off on justice for people of color. It really fanned the racial flames. Went off on the potential sentence asking what it would be if the roles were reversed? When she gets only 5 there's going to be some unrest, if that's what she gets.

Absolutely riveting stuff...the locals are all on this trial. Been watching for awhile now.

Sentencing may take up to 6 hours. Going to be potentially trotting out lots of people in this phase. Going to be very passionate stuff on both sides.

Who determines, in this case, how much time....judge or jury?
Either way, as the jury seems to be making a statement here, I don't see less than 17 yrs., and that will be a 'minimum', no credits given. Murder conviction...it says something.

Me too. I'm not surprised she was found guilty (and should have been IMO), but I really thought it would be of manslaughter.

From what I heard reported the jury will make that decision.

My own personal read on Amber is she wasn't believable nor sympathetic. This was brought up during much of the coverage that although this is about law, it is also about emotion. Amber didn't sell well. The text messages just 2 days after the trial were brought up about how she wanted to get bombed and have sex. The fact the guy she was having sex with shot an unarmed black man back in 2007 probably didn't help her cause.

Like you, Rex, I'm stunned they went murder but only after hearing the questions they had. The sentencing phase which is set for less than an hour is going to be over the top interesting. A buddy of mine thinks 15-20. I think lower. You think 17 which is right where my buddy thinks. It was just brought up that 15 years might be the figure...missed the reasoning as I was typing.

I know the attorneys for Jean were fearing a light sentence and railed against it. If she gets low years, there could still be riots. Can't wait to see what the jury decides.

Appeal is possible even though Jean's attorneys said they didn't believe there'd be one. How could there not be? She may get off when all is said and done.

EDIT: Reported a lot of legal experts expected her to get off on all charges as is no manslaughter...guilty of nothing from a legal perspective.

Given they had 3 choices of the charges, they had to do eliminations; could only convict on 1 count, as I understand the system. Appears they started with the lesser charges and went up.

Toulon Appeal is possible even though Jean's attorneys said they didn't believe there'd be one. How could there not be? She may get off when all is said and done.

I know in some states, appeal is automatic in murder convictions.

It was all about race per the comments after the trial. It was sad to see they didn't focus on justice for Botham Jean, they made it about several others and went on about precedent. This was about what it was but no question race and cop were factors. To make them the thing after was a bad look for her legal team. It was smack talk into a situation that is already volatile. The emotions got the best of them there.

EDIT: I just heard it reported that even Botham Jean's attorneys didn't expect a guilty verdict after hearing the jurors had asked the judge the questions on manslaughter and castle law.

As far as sentencing, I'm going low, low end... I'm sticking with my original hope of 8 years. Range is anywhere from 5 to 99. Jean's attorneys said this jury set a precedent...and they did. I don't think they have it in them to really stick it to her after actually convicting her of murder. They made their big statement. I expect a much smaller one in sentencing.

Don't know if this played into the verdict, but I just heard radio dude (news reporter) explain that the Dallas police have a protocol that the officer is supposed to retreat and call for backup in the event they interrupt a burglary in progress - as some have commented about above. So it sounds like she not only ignored her surroundings, but also her dept. training.

I don't know. It was reported he was sitting on his couch eating ice cream when he got plugged. Don't think too many burglars, or threats in general, would be doing something like that. Not saying eating someone's ice cream isn't deserving of a gun shot. When someone touches my chocolate chip cookie dough, I get a little crazy myself.
