You have an insurance agent. At least talk with them before you accept any funds.
In 2007 my wife was involved in an accident, two cars totaled and a third heavily damaged. It was a testimony to air bags and modern car design that no one suffered severe injuries. My wife was taken by ambulance to the hospital as she was in shock. The accident was just a few blocks from EMT service. She was unconscious when they arrived. She was really banged up by the air bag and impact, but no broken bones or fractures. After a few weeks she felt she was healing and did not expect a delayed reaction. It was about 6 weeks after the accident her upper back and neck began to become tender and then outright painful. I appreciate that our agent and a friend who settles claims for an insurance company (not involved) advised us to not take any funds for injuries for a considerable period of time. I don't have a clear memory, but you have a generous window of time to settle pain and suffering in Kentucky. When you sign and cash a check for this purpose you have settled. Don't do it until you are sure.
We settled on the replacement of the car within about a month and they paid for the rental during this period. Our car had very low mileage and they agreed to a market analysis of the current selling price in our market place. We received a bit over a $1,000 above their first offer which was the highest value in the blue book. I was pleased as the offer was spot on my own research. At that time the Honda Civic model she was driving was bringing much more than the blue book. Be sure to isolate this settlement from medical and pain and suffering. Then we sent them all the medical bills which they paid in a timely manner. It was almost a year later that my wife was without periods of pain. At this point we began to discuss pain and suffering. Their opening offer was now far beyond what they first offered for the simple fact there was a bunch of medical bills directly related to the accident. I did seek advice from my friend in this business as to a proper settlement. They balked at first, but again I had a good amount of information which ended the matter with a check. I felt the people I dealt with represented their company well. It became apparent they realized I had someone behind the scene helping me.
The young teen that slammed into my wife with his brand new fire orange Mustang and max power package his parents had bought for him two weeks before good insurance with a reputable company. Our car totaled. A van across the street which he shoved my wife into had major damage, but I don't believe it was totaled. He T-boned my wife in the passenger door. He was doing at least 40 mph and there was zero evidence of an attempt to brake. I suspect he was on his i-phone, but who knows. We never had any contact with him or his family, probably best. I don't think we came anywhere near his insurance max, but I was satisfied because I felt what we received was fair. I was thankful he did have insurance and good coverage. I carry insurance to protect ourselves from the uninsured, but medical bills can be outrageous these days.
