Par4QC If he was actually charged with criminal mischief for >$1000 in damage I’d assume it is as much or more about the drone as it is the shooting - unless he missed badly and shot a neighbor’s property (house or car).
Did this 71 year old man deserve being arrested/charged with a felony?
I would think that at some point a low flying drone could be considered an invasion of privacy. I don't like of idea of using drones to deliver products, but hey I'm a middle class American.
Yipsy give me a break. Seriously. Drones aae all over this country. Not aware of any bombs being delivered via drone in America.
The fact that the guy is paranoid doesn't excuse his behavior. What if he was a coolrophobe; ok for him to open fire on the clown at this neighbor's kid's birthday party?
Also, the fact that nobody got hurt is irrelevant. Using that logic, people could drive drunk all they wanted and as long as they don't get in a wreck it should be ok? Another example from the law is that if you attempt to shoot someone dead but miss, you are still charged with attempted murder, even though you didn't hurt anybody at all. Or if you poimt a gun at somebody's head and fire it, thinking it is loaded, you can get charged with attempted murder even if the gun was actually unloaded.
sdandrea1 This has not been worked out yet, though some here think they know. The laws are old the govt is "exerted" control that is not inherent. Airspace, same with spectrum, needs to be updated.

Even in the case of drunk driving, outcome and level of negligence plays a part in the severity of the charge. 1st DUI and no one hurt - almost always a misdemeanor. DUI with children in the car - elevated charge. 5th DUI - willful neglect and elevated charge. DUI with severe injuries or death could elevate all the way to involuntary manslaughter.
While I don’t think this man used good judgment, I’m inclined to say he shouldn’t get jail time unless he has past issues of negligent firearms handling.
Yipsy People have been harmed by people discharging firearms, just the way people have been harmed by drunk drivers. That's why it is illegal to discharge a firearm in a freaking neighborhood. So I thank you for agreeing with me.
I don't think we should not punish somebody for drunk driving just because they got lucky and didn't injure someone. In the same way, this guy needs to be punished, because his actions were reckless and negligent.
Should he go to jail? Probably not. But it makes perfect sense to make sure that he and others like him understand that they can't just go shooting at anything that flies near their house. Give him community service at the least. Tell hum if he discharges his firearm unlawfully again, he will lose his right to own a firearm.
